Assemblymember Bauer-Kahan Introduces Groundbreaking Bill to Regulate AI Use for Children

AB 1064 Establishes Oversight Board to Ensure AI Technologies Used by Children Are Safe and Ethical

[Sacramento, CA] – Today, Assemblymember Bauer-Kahan, in partnership with Common Sense Media, introduced AB 1064, the Leading Ethical AI Development (LEAD) for Kids Act, a first-of-its-kind bill aimed at safeguarding children from the growing risks of artificial intelligence (AI). The legislation establishes the LEAD for Kids Standards Board within the Government Operations Agency to assess and regulate AI technologies used by children.

As AI becomes an increasingly integral part of education, entertainment, and social interactions, concerns over its safety, privacy, and ethical implications have grown. AI-powered learning tools, social media algorithms, and interactive chatbots are being widely used by children—often without proper oversight. Reports have surfaced of AI chatbots engaging in inappropriate or harmful conversations with minors, including encouraging disordered eating or even self-harm.

"AI has incredible potential to enhance education and support children’s development, but we cannot allow it to operate unchecked," said Assemblymember Bauer-Kahan. "Tech companies have prioritized rapid development over safety, leaving children exposed to untested and potentially dangerous AI applications. AB 1064 ensures we put safeguards in place to protect young users. Common Sense Media, a leading nonprofit advocating for children’s digital well-being, has been at the forefront of addressing the risks posed by AI. The bill is also supported by the Organization for Social Media Safety, Children's Advocacy Institute, Jewish Family and Children's Services, and the Transparency Coalition.

Key Provisions of AB 1064:

  • Creates the LEAD for Kids Standards Board to oversee and regulate AI systems used by children, ensuring ethical development and deployment.
  • Requires risk-level assessments by developers to classify AI systems based on their potential harm to children, with stricter requirements for high-risk systems, including pre- and post-deployment evaluations.
  • Prohibits certain harmful AI applications for children, including emotionally manipulative AI chatbots, emotion detection systems, social scoring systems, and certain facial recognition technologies.
  • Mandates transparency and oversight by establishing a registry for covered AI products, requiring incident reporting for harms caused by these systems, and enforcing periodic independent audits.
  • Strengthens privacy protections by requiring affirmative, written parental consent before a child’s personal information can be used to train an AI model.

This legislation is in response to the rapid expansion of AI in children's lives without sufficient regulatory oversight. While AI has been leveraged to personalize education and improve learning outcomes, its risks—ranging from privacy violations to psychological harm—remain largely unaddressed.
